The company reserves the right to request Know-Your-Customer (KYC) documentation, conduct counterparty verification, and decline any enquiry, registration, or transaction suspected of involving unlawful, sanctioned, or non-compliant activity.

2.5 Electronic System & Shark One Platform Compliance
Where required under applicable Indonesian electronic system regulations, PT Shark Capital Investment will comply with requirements relating to private electronic system operation, electronic records, platform security, user access, personal data protection, and digital service governance.
Shark One is operated as a business coordination gateway for enquiries, supplier registration, document uploads, internal review, finance coordination support, and shipping/logistics workflow. It does not function as a public exchange, regulated financial marketplace, payment system, securities platform, or licensed banking platform.
2.6 Anti-Bribery, Anti-Fraud & Ethical Conduct
PT Shark Capital Investment does not tolerate bribery, corruption, facilitation payments, forged documents, misrepresentation, sanctions evasion, money laundering, terrorist financing, or fraudulent transaction structures.
The company reserves the right to reject, suspend, terminate, or report any enquiry, registration, transaction support request, or business relationship suspected of involving unlawful, unethical, misleading, or non-compliant conduct.

Any commercial transaction, supply arrangement, finance coordination, or business relationship shall only become binding upon execution of a separate written agreement signed by authorized representatives of the relevant parties, following completion of required due diligence, verification, and compliance review.

Any dispute, claim, or controversy arising from or relating to these Terms, the Platform, or services provided by PT Shark Capital Investment shall first be attempted to be resolved by good-faith commercial negotiation between the parties.
If a dispute cannot be resolved through negotiation within thirty (30) calendar days, the parties shall submit to the jurisdiction of the competent courts in Surabaya, East Java, Indonesia, unless the parties expressly agree in writing to an alternative dispute resolution mechanism.
4.11 Amendments to Terms
PT Shark Capital Investment reserves the right to amend these Terms at any time. Updated Terms will be published on the Platform with an updated effective date. Continued use of the Platform following publication of amended Terms constitutes acceptance of the amended Terms.

Before submitting any enquiry, supplier registration, finance coordination request, shipping request, or document upload, users may be required to confirm acceptance of the Privacy Policy, Terms of Use, Legal & Compliance policy, Disclaimer, and Risk Disclosure.
By submitting information through the Platform, the user represents that the information is true, accurate, lawful, and submitted with proper authority from the relevant company, supplier, buyer, trader, investor, or organization.
Electronic submissions, acknowledgements, reference numbers, and platform communications are for coordination and record purposes only and do not create a binding transaction unless confirmed in a separate written agreement signed by authorized representatives of the relevant parties.
Risk Disclosure
International trade, commodity transactions, trade finance coordination, cross-border shipping, project finance, and global business activities inherently involve commercial, financial, legal, logistical, and regulatory risks. Commodity prices - including CPO/palm oil, coal, nickel, rubber, cocoa, coffee, copra, and other Indonesian commodities - are subject to significant and rapid market fluctuation driven by global supply-demand dynamics, geopolitical events, weather conditions, and speculative activity. Price indications provided on our platform or in any communication are indicative only and may change materially before any transaction is confirmed.
Commodity availability, specification, quality, grading, moisture content, and quantity cannot be guaranteed until independently inspected and verified by an internationally recognized inspection agency (such as SGS, Intertek, or equivalent) at the point of production or loading.
International transactions are subject to foreign exchange rate fluctuation between Indonesian Rupiah (IDR), US Dollar (USD), and other relevant currencies. Exchange rate movements can materially affect transaction economics, pricing, profit margins, and settlement obligations.
All market price references, freight rate indications, and commodity market data provided through our platform or Live Market Watch are indicative only, subject to change without notice, and should not be relied upon as the basis for commercial decisions without independent verification from recognized market sources.

Vessel availability, freight rates, port scheduling, and stevedoring capacity are subject to market conditions, seasonal demand, port congestion, and force majeure events. Freight cost indications are indicative only and may change materially at time of booking.
Shipping documentation - including Bills of Lading, Phytosanitary Certificates, Certificates of Origin, SGS/Intertek inspection reports, and Commercial Invoices - must comply precisely with LC terms and applicable import country requirements. Documentation errors may result in delays, refusals, or financial loss.
Customs clearance at destination ports is subject to the importing country’s regulations, tariff classifications, import duties, prohibited goods lists, phytosanitary inspection, and regulatory approvals outside PT Shark Capital Investment’s control.
Under ICC Incoterms® 2020, risk of loss or damage transfers between buyer and seller at the agreed delivery point. Parties must fully understand the risk allocation implications of the agreed Incoterms term before entering into any sale contract.

5.10 Commodity-Specific Licenses, Permits & Government Approvals
